Hurricane IT Terms and Conditions:

These terms and conditions apply to the supply of services and goods by Hurricane IT ABN 27 567 651 214 (“we” or “us” or “our“).

1.0 Definitions:

In these conditions:

“Customer” or “you” means a person, firm or corporation, jointly and severally if more than one, that is provided services by us;

“goods” means all products and other goods (including any software) supplied by us for you or on behalf of you;

“services” means all services performed by Hurricane IT for you or on behalf of you;

“including” is not a word of limitation and it means without limitation;

“Conditions” means these Terms and Conditions;

“ACL” means the Australian Consumer Law being Schedule 2 to the Competition and Consumer Act 2010;

“Party” and “Parties” means (severally and not jointly) Hurricane IT and/or the Customer as the context requires.

2.0 No Fix No Fee" Guarantee:

While we will do our best to repair/fix('fix') your property if we are unable to do so or unable to provide a solution you will not be charged for our services. However if our advice is that you upgrade your property or buy software at cost to you a fee may still be charged for our services if you do not follow the advice to upgrade as this is considered a solution.

3.0 Warranty:

3.1) A 14-day guarantee is given on all services completed by Hurricane IT wherein only the work on the invoice is covered. We may elect to send the same technician to fix the problem. However if you decide to get another tech service or technician to solve the problem we will not reimburse the costs of their services. Our technicians reserve the right to determine if the cause of the problem is directly caused by or related to the service completed and if we determine it is not related no reimbursement will be given (by way of money or services).

3.2) 3-Month warranty on all pc upgrades: we offer a 3-month warranty on all pc upgrades whether purchased by you or provided to you by us. Proof of purchase is required for all warranty claims.

3.3) We offer a 6 month warranty on all assembled systems by us. however it will not be covered if the hardware faults are caused by viruses, software/programs or by the operating system. It will also not be covered due to damage caused to the system whether intentional or due to carelessness including spills or falls. Invoice must be supplied with all warranty claims.

3.4) Where applicable, You are responsible for any courier costs and insurance costs for purchased and warranty goods.

4.0 Our Service:

4.1) We agree to complete out the services agreed as displayed in your invoice and by using these services you agree to comply with these Terms and Conditions

4.2) By using our services you agree that we may need to take your system or our premises or a third party site for diagnosis and repair. While in our possession we will give all due care to prevent any damages or loss from occurring.

4.3) Any date given for return of your property or repair completion is an estimate only. while we endeavor to meet any of dates provided it may take longer however will try and give you as much notice as possible to let you know of any delays.

5.0 Services and Pricing:

5.1) Unless otherwise agreed upon with us the services are strictly payed upon completion of service. We accept payment by cash or credit card. Payment is required before we can release your property.

5.2) If you give us less than twenty-four (24) hours’ notice before you cancel a on-site repair we may charge you a cancellation fee.

5.3) Service pricing will be constantly maintained and kept up to date on the website and any other price displayed elsewhere may be out of date and the prices displayed on the website override any price displayed elsewhere.

5.4) Any advice given outside out of proffesional consultation or our services are not to be quoted and we will not be liable for any damage or injury caused by the advice.

6.0 Transportation:

6.1) If you require us to collect or return your property at your premises or other premises a cost will be included with the final invoice. however we do not charge for us taking it back to our or third party premises.

6.2) Pertinent to your location if there are any sundry expenses including parking it will be added to the invoice. you must provide accurate parking instructions if located in a difficult area such as Perth CBD

7.0 Customer’s Responsibilities:

Home or Office Repairs (on-site):

7.1) For your safety we ensure that our staff undergo regular police checks.

7.2) Either you or an adult (18+) must be present at all times when our technicians are there to provide our services.

7.3) You must ensure that we have access to the site at the agreed upon time and you or an authorized person have permission to grant the technician access to the premises.

7.4) You agree that the premises are safe and free from any safety or health hazards. Our technicians reserve the right to refuse provision of the service/s if they feel they are unsafe.

All Services:

7.5) Our technicians must be provided with:

Any and all password/s to provide services;

Electrical power and internet access if required;

Any cords needed including power cable;

For installation of software or operating system the installation cd or key must be provided unless the goods are provided to you by us.

8.0 Limited Liability:

8.1) The goods and services come with warranties that can't be excluded under the ACL and any major problems with us will allow you to.

Cancel your service contract with us or a refund of any unused services payed for;

You are entitled to choose a refund or replacement for major failure with our services;

Have us fix the failure of service in reasonable time otherwise a refund for the failure in service.

8.2) Fixing or repairing computers is inherently risky and while we will try our best to prevent loss of data we hold no responsibility for loss of data due to services provided by us. You are strongly recommended to back your system to prevent any potential loss.

8.3) You agree that to the extent of the law we are not responsible and not liable to the below whether by negligence or otherwise:

Interruption to business;

any loss due to access delays to, interruptions to, or discontinuation of a service;

loss of data due to the service or repairs;

any damages or losses of any sort incurred as a result of using our services;

Viruses, malfunctions or system failures in regards to the supply of services to you.

8.4) By using our services you agree to indemnify us from all claims, demands or otherwise in regards to any loss, damages, injury, expense/s, cost/s or liability whether it is indirectly or directly caused by us.

8.5) As far as the law permits, We are not liable for any loss, theft, damage or injuries however it is caused. This extends to any third parties involved.

9.0 Mandatory Repair Notices:

9.1) Property presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods;

9.2) The repair of your property may result in the loss of any user-generated data. Please ensure that you have made a copy of any data saved on your property.

10.0 Feedback and Reviews:

We at Hurricane IT appreciate and respect all feedback given to help us improve. By leaving feedback or a review you agree to the use of either on our website and other media without the need for further consent from you.

Any and all backups made as part of the service will be destroyed once the service is complete except for backups given to the client.

Website Marketing:

We may with your permission send you out a newspaper containing relevant information of our services, discounts, products and any promotions we are running.

At all times you will have the option to opt out of these newspaper and will provide easy steps to do so.

These newspapers may be sent in the form of text, email or any other electronic means.

Policy Changes:

We reserve the right to change our policies at any time however should this occur we will update our policies on the website.
